General Information

The following General Terms and Conditions of Sale may be modified or updated at any time by ITA23 GROUP SRL, which will promptly inform the clientele by updating them online. The terms applicable to the commercial transaction will be those present on the dedicated webpage of the portal.

Customer Obligations

Before submitting their purchase order, the Customer is required to read these sales conditions carefully. Submitting the purchase order implies full knowledge and acceptance of these terms. Finally, once the online purchase procedure has been completed, the Customer must print and keep these general terms and conditions of sale, which have already been viewed and accepted during the contract conclusion phase.

Privacy Policy

SUBJECT: Information and request for consent pursuant to and for the purposes of Articles 13, 23, and 26 of Legislative Decree 30.06.2003 n. 196, concerning the protection of personal data processing. The seller informs the Customer pursuant to and for the purposes of Article 13 of Legislative Decree 196/2003 that:

The aforementioned Legislative Decree provides for a series of obligations on those who carry out “processing” (i.e., collection, registration, processing, storage, communication, dissemination, etc.) of personal data relating to other subjects, prescribing the duty to inform the interested parties about the rights recognized by law and the characteristics of data processing;
The processing of personal data requested from the Customer and communicated by them will be carried out at the seller’s premises in compliance with the principles of necessity and relevance using procedures, including computerized ones, for legal and fiscal obligations and for the execution of contractual obligations;
The data controller is the seller. The data processing manager is domiciled for legal purposes at the same company’s headquarters. During such processing, the data controller and the appointed personnel may become aware of the data, which will be processed in compliance with privacy laws and principles of fairness;
Processing will be carried out using manual and automated systems designed to store, manage, and transmit the data, with logic strictly related to the processing purposes, based on the data in our possession and with the Customer’s commitment to promptly communicate any corrections, additions, and/or updates;
Except for communications and disclosures made to comply with legal and contractual obligations, the data provided to the undersigned will be used exclusively for legal obligations;
The nature of the provision is strictly necessary concerning the purposes of the above-mentioned processing. The provision of the aforementioned data by the Customer is essential for the accurate fulfillment of the activities listed above. Any refusal makes it impossible to properly comply with contractual and legal obligations, compromising the continuation of the relationship established between the parties;
The Customer can exercise their rights at any time towards the data controller, pursuant to Article 7 of Legislative Decree 196/03, in particular to:
- know the existence or not of personal data concerning them and their communication in an intelligible form;
- be informed about the data controller, the purposes, and methods of processing, and the possible manager, on the subjects or categories of subjects to whom personal data may be communicated;
- obtain the updating, rectification, or integration of data;
- obtain the cancellation, transformation into anonymous form, or blocking of the same;
- object for legitimate reasons to the processing of data, within the limits established by law;
- object to the sending of advertising material or for carrying out market research or commercial communication.

Order Definition

When the Customer places an online order for products they have added to the cart, they agree to purchase them at the price and under the terms indicated in these Terms and Conditions of Sale. ITA23 GROUP SRL will communicate the acceptance and confirmation of the order to the customer.

Purchase Methods

The Customer purchases the product, whose characteristics are illustrated online in the respective descriptive and technical sheets, at the price indicated therein, to which VAT and delivery costs specified on the website are added. Once the purchase order has been submitted, the Customer will receive an email from ITA23 GROUP SRL confirming the receipt of the purchase order, containing information on the purchased goods, a detailed indication of the price, delivery costs, payment methods, and a reference to the general terms and conditions of sale and information on the existence of the right of withdrawal with conditions and methods of its exercise as shown on the website.

Payments

The Customer can make the payment due by choosing one of the following listed methods.

Payment by credit card and Paypal:

All Credit Cards from the Visa and Mastercard circuits, CartaSì, BancoPosta credit card, and PostePay credit card are accepted. Payment is made via the secure Paypal server.

Payment by advance bank transfer:

Payment by bank transfer can be made using the following details:

The transfer must mention the details reported in the order placed on the website:

Order reference code;
Name and Surname of the order holder.

With this payment method, the order will be sent only upon the actual crediting to the ITA23 GROUP SRL bank account. After 3 working days, if the transfer has not been received, the order will be considered null and therefore not processed, after prior email notification to the Customer.

Displayed Prices:

All product prices are clearly indicated on the site and are net of VAT and transport costs, which will then be added before the total order amount to be paid.

Product Availability

If an order exceeds the quantity available in stock, ITA23 GROUP SRL will notify the lack of availability within 3 working days and the possible waiting time for order fulfillment. If the customer does not agree to wait for the necessary delivery time, the contract will be considered terminated, and ITA23 GROUP SRL will immediately cancel the payment.

Invoicing

A commercial invoice is issued for each shipment.

Right of Withdrawal

The Customer has the right to exercise the right of withdrawal without any penalty and without specifying the reason, within 10 (ten) working days from receipt of the goods. The right of withdrawal is exercised by sending, within the aforementioned term, a written communication by registered letter with acknowledgment of receipt to the following address: ITA23 GROUP SRL via SS. Crocefisso, 12 Taurisano (LE) The withdrawal communication can also be sent, within the same term, by email (info@ita23group.it) provided it is confirmed by registered letter with acknowledgment of receipt within the next 48 hours. WARNING: In the letter requesting the exercise of the right of withdrawal, it is necessary to indicate the details of a bank or postal current account to refund the amount due, excluding shipping costs (IBAN account holder and order reference code). To exercise the right of withdrawal, it is necessary that:

The Customer expresses their intention to exercise the right of withdrawal in the manner described above
The purchased item is intact and returned in its original packaging, complete in all its parts (including documentation) and not used. A copy of the electronic order receipt must be attached to the returned product.
The product is returned within the times and in the manner described above. The return shipping costs are entirely borne by the Customer. It is understood that the risks of transportation for the return of the goods are entirely borne by the customer.

ITA23 GROUP SRL has the right to reject any product returned in ways other than those specified above, as well as products for which the return shipping costs have not been fully paid by the customer, or the procedures and times indicated for the communication of the exercise of the right of withdrawal have not been respected. ITA23 GROUP SRL is not liable in any way for damage or theft/loss of goods returned with uninsured shipments. The refund only covers the price of the product (excluding shipping costs) and will be made within and no later than 30 days from the moment the goods are returned for which the right of withdrawal is to be exercised.

When the Right of Withdrawal Expires

The right of withdrawal expires in the cases where ITA23 GROUP SRL ascertains:

Partial use of the product;
The absence of the external packaging and/or the original internal packaging;
The absence of integral elements of the product;
Product damage due to causes other than transportation;
For products made to measure or personalized by the Customer.

In the cases indicated above, ITA23 GROUP SRL will return the purchased product to the sender, charging them for the re-shipping costs.

Express Termination Clause

ITA23 GROUP SRL reserves the right to terminate the contract by giving simple notice to the customer with adequate and justified reasons. In such cases, the Customer will only be entitled to a refund of any sum already paid.

Jurisdiction

For any dispute relating to the interpretation and execution of the contract, the competent court is that of Lecce.
